These Terms & Conditions outline the agreement between you, our valued cultivator, and HORTOLOGY (“we”, “us”, “our”) regarding your use of our website (hortologys.com) and purchase of our products. By accessing our site and making a purchase, you agree to these terms. We invite you to read them mindfully, as they are designed to foster clarity, trust, and a harmonious relationship.

1. Our Philosophy & Your Acceptance

At HORTOLOGY, we are dedicated to helping you create a serene and thriving indoor space. Our collections—from CALMING INFLUENCE and EARTHY OPULENCE plant pots to living HOUSEPLANTS and specialised PLANT CARE products—are curated with intention. These terms are an extension of our care, setting clear expectations for our mutual journey.

By using our website, you confirm you are at least 18 years old and have the legal authority to enter into this agreement. You agree to provide accurate and complete information during registration and purchase.

2. Product & Service Description

We offer a curated range of products to support your indoor garden:

• Living Plants & Specimens: Including items from our HOUSEPLANTS, Cacti & Succulents, Foliage, CALMING INFLUENCE, and EARTHY OPULENCE collections. These are perishable, living beings, selected and shipped with utmost care.
• Plant Pots & Planters: Crafted collections such as GLEAM & SHINE, FIBRECLAY, SEA & SKY, and PLANT POTS BY COLOUR.
• Care & Tools: Products from PLANT FOOD & TREATMENTS, PLANT CARE, Atomisers & Misters, and Grow Pots & Tools.
• Accessories & Styling: Items from HOUSEPLANT STYLES and POTTING, PLANTING & DISPLAY.

We strive for accurate product descriptions, images, and pricing. Minor variations in colour or texture may occur, especially in handmade pots and living plants, which we consider part of their unique character.

3. Orders & Payment Terms

3.1 Placing an Order

Adding an item to your cart does not reserve it. An order is only confirmed once you receive an order confirmation email from us. We reserve the right to refuse or cancel any order before dispatch, including for stock errors, pricing errors, or suspected fraud.

3.2 Pricing & Payment

All prices are in British Pounds (£). We accept Visa, MasterCard, JCB, and PayPal. You authorise us to charge the total amount (including shipping and taxes) to your chosen payment method upon order confirmation.

Prices are subject to change without notice. The price charged is the price valid at the time your order is placed.

3.3 Shipping & Delivery

We ship globally, excluding parts of Asia and remote regions where delivery is not feasible.

• Order Processing: Please allow 1-2 business days for us to mindfully prepare your order.
• Shipping Methods:
  • Standard Tracked Shipping: £12.95 via DHL or FedEx. Delivery typically 10-15 business days after dispatch.
  • Complimentary Shipping: Free for orders over £50 via EMS. Delivery typically 15-25 business days after dispatch.

Delivery times are estimates. You are responsible for providing a correct and deliverable shipping address. Any import duties or taxes for international orders are the customer’s responsibility.

4. Returns, Exchanges & Refunds

Our policy is designed to be straightforward and fair, honouring both your needs and the nature of our products.

4.1 General Policy

You have 15 days from the date of delivery to initiate a return or exchange for unused items in original condition and packaging. The process is as follows:

1. Contact our care team at [email protected] within 15 days using the provided request template.
2. Await our Returns Authorisation Number and instructions. Do not return items without this.
3. Pack items securely in original packaging with all accessories and the completed returns form.
4. Ship using a tracked and insured service to the address we provide. Return shipping costs are your responsibility unless the return is due to our error or a faulty item.
5. Upon receipt and inspection, we will process your refund or exchange.

4.2 Non-Returnable Items

To preserve their integrity, we cannot accept returns for:

• Live Plants & Specimens (unless significantly damaged or incorrect upon delivery – must be reported within 48 hours with photos).
• Opened or used PLANT FOOD & TREATMENTS, Houseplant Treatments, or PLANT CARE products.
• Personalised or made-to-order items.
• Items not in original condition or packaging.

4.3 Refunds & Exchanges

Refunds: Issued to the original payment method within 5-10 business days of us receiving your return. Original shipping costs are non-refundable unless due to our error.

Exchanges: We will ship the replacement once the original return is received and inspected. Price differences will be settled prior to dispatch.

5. Intellectual Property

All content on this website—including text, graphics, logos, images, product designs (such as those in our COMPOSITE or FIBRECLAY collections), and the overall “look and feel”—is the property of HORTOLOGY or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6. Limitation of Liability

HORTOLOGY is dedicated to quality and care. However, to the fullest extent permitted by law:

• We shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website or products, including but not limited to loss of profits, data, or anticipated plant growth.
• Our total liability for any claim related to your order shall not exceed the total value of that specific order.
• We are not liable for delays or failures in performance due to events beyond our reasonable control (force majeure).
• The information on our site is for general guidance. We are not liable for individual plant care outcomes, as these depend on numerous environmental factors.

7. General Provisions

Governing Law: These terms are governed by the laws of England and Wales.

Changes to Terms: We may update these terms periodically. The current version will always be posted on our website.

Severability: If any part of these terms is found to be invalid, the remainder will continue in full force.
